Article 1– This seasonal rental contract is reserved exclusively for the rental ‘Blue Hole Gardens’.
Article 2 – Length of the stay: The tenant signing this contract for a specific length of time cannot in any way exercise a right to remain in the accommodation at the end of the stay.
Article 3 – Conclusion of contract: Booking becomes effective when the tenant has paid the full amount for the rental period.
The rental concluded between the two parties can in no case be used by other persons without the owner’s written approval. Breach of this article may lead to the immediate termination of the rental and the total amount of the rental will be due the owner.
Article 4 – Cancellation by tenant: All cancellations must be notified to the owner.
a) Cancellation before arrival:
No refund will be issued if the cancellation is made less than 45 days before the date of entry into the accommodation. A 50% may be issued should cancellation be made 45 days ahead of entry into the accommodation.
If the tenant does not show up within 24 hours of the date of arrival on the contract, this contract is null and void and the owner is free to dispose of his gîte. The rental amount is not refundable and the total amount of the rental will be due to the owner.
b) In case of a shortened stay: The amount of the rental remains due to the owner, and there will be no refund for the tenant.
Article 5 – Cancellation by the owner: The owner returns the full amount paid by the tenant.
Article 6 – Arrival: The tenant must arrive on the day and at the time agreed. In case of late or delayed arrival, the tenant must warn the owner.
Article 7 – Inventory: An inventory is carried out and signed both by the tenant and the owner or a representative on entering and leaving the gîte. This inventory is the only reference in the case of claims as to the state of the gîte. The cleanliness of the gîte when the tenant enters will appear on the inventory.
Article 8 – Deposit: Prior to arrival a security deposit of $250 is requested by the owner which can be paid by credit card or via Paypal. After the final inventory this deposit is fully refunded except in the case of damage. In the case of a stay being cut short thus rendering an inventory impossible, the security deposit will be returned to the tenant within two weeks.
Article 9 – Use of the accommodation: The tenant must ensure the peaceful nature of the accommodation and use it for its established purpose.
Article 10 – Capacity: This contract is drawn up for a maximum number of people. If the number of tenants exceeds the capacity, the owner has the right to refuse the extra persons. The tenant will be considered liable for any modification or breach of contract.
Article 11 – Pets: This contract stipulates that the tenant is not allowed to bring pets. If the tenant does not respect this clause, the owner can deny access to the gîte. In this case, no refund will be made.
Article 12 – Claims: Any complaint related to the inventory or differences between the description and the actual rental, must be lodged with the owner or owner’s agent within 3 days of the start of the contract. Any other claims must also be addressed as soon as possible by letter.
Article 13 – Insurance: Guests stay at their own risk and are responsible for any accidents that might incur on the property including theft and medical emergencies. We strongly recommend you have a comprehensive travel insurance policy for the duration of your stay.
Article 14 – Shopping. A shopping service can be provided for guests at an additional cost of $17. This involves a member of staff carrying out the shopping on behalf of guests at Savana-La-Mar.
Article 15 – House-keeping. A mandatory house-keeping fee will be charged at a rate of $20 per couple per day. This fee covers all cleaning and cooking carried out by our wonderful staff and will be charged in addition to your rental costs separately. Payment can be made by credit card or Paypal prior to your arrival.
